Taxi Driver held for Alleged Assault on Passenger

Hey guys I just got back from Seattle and I wanted to share this somewhat repulsive auto related crime coming out of the Denver area. According to the Denver District Lawyers Office a cab driver, Patrick McCracken, 39, is accused of sexually assaulting a female passenger. The defendent in this case has said that the encounter was consensual.

However, prosecutors have contended that it not really possible for the victim in this case to give her consent since she was very drunk at the time of the attack. She had apparently been celebrating her 21st birthday, when she rode in McCracken’s auto. She said that she passed out in her home and upon waking up she was alarmed to find the defendent on top of her, and the prosecution believes that this was no accident. She has also claims that he gave her a credit card receipt and then told her to clean out his auto since she had the nerve to throw up in the auto during the ride to her residence.

Because of these particular facts the Denver District Lawyers Office prosecutors states that the victim was not capable of giving her consent to have sex with McCracken as stated by the 39 year old man.
All in all, he is being held in lieu of $35,000 bail after being charged with the alleged sexual assault. This guy had better have himself some good lawyers.

Colorado Bank Robber Bob Arrested

In Colorado criminal news, the bank robber who media writers have aptly called ‘Bank Robber Bob’ has been detained and booked. He is now simply know by his given name, John Lehman. He apparently (if the charges hold up in court) stole from several different banks in Metro Denver, Colorado. There has been no other personal information released about him at this time, and it is not clear if he has yet to retain a defense lawyer.According to Special Agent Kathy Wright of the FBI, the defendent in question was taken in near 17th Avenue and Sheridan Boulevard. The Denver and Edgewater, Colorado police assisted the feds in the arrest of the aforementioned criminal suspect.   Agent Wright stated that the criminal defendent in this case is suspected of stealing funds from the Provenant Federal Credit Union on June 13, July 10 and also on September 19th. During the last robbery he is alleged to have gotten into a fight with employees and injured his head during a scuffle with 2 employees he left a blood trail from his head injury.  There is simply no defense either for the criminal act (if he is guilty) or the stupidity of those actions. International Art Thief Sentenced In Miami Criminal Court

I just got back from Sacramento and wanted to post some criminal law headlines from elsewhere in the country. The art thief Bernard Jean Ternus of France has been sentenced in a US District Court in Miami Florida. The US District Attorney for the Southern District of Florida R. Alexander Acosta was the prosecutor in the case where presiding U.S. District Judge Patricia A. Seitz sentenced Ternus to a total of about five years in jail, 3 years supervised release and $200 special assessment. It is not clear if his defense attorney on the case will appeal the decision or what his defense will be.

This stems from the art theft that Ternus plead guilty to, of an August 5, 2007 armed robbery at the Musee des Beaux-Arts in Nice, France. As a Museum of fine art, during the armed robbery Ternus stole four original paintings in the brazen act.
Following the criminal act in question from August of 2007 through June of 2008 Ternus and his cohorts had meetings a few times with undercover FBI agents and an undercover officer of the French authorities in an attempt to sell the stolen merchandise. All in all, they were later shown pieces of the art work at a meeting in a third European country. He went in front of U.S. District Court Judge Cecilia A. Altonaga in Miami as his Attorney failed to get his case dismissed, at least in the opening round. As previously noted it is unclear as to whether an appeal is planned but I would guess that one is.

Man Suspected In Area Robberies Arrested

I just got back from Chicago and i wanted to share this interesting story with you.

According to the Commerce City Police they have arrested a man suspected of as many as eight area robberies. The man that was arrested on the alleged charges has been identified as 26 year old Benjamin Foos and this comes after a ten day investigation.  He had better have a qualified attorney

Benjamin Foos has been charged in the robberies he is suspected of with three counts of aggravated robbery, one count of menacing, along with five counts of criminal attempt to commit aggravated robbery according to police. it is not entirely clear at this time if had the intent to commit personal injury or not. The alleged robberies that Foos is charged with included the use of a weapon.

Westminster and will be answering to the charges when he appears in court, presumably with his attorney.  Detective Saunders also stated that Foos is currently at the Adams County Detention Facility.

Three California Boys Arraigned for Kidnapping of Young Girl

Here is another tale from the Dark Side, unfortunately. I have to admit it made me a little sick when I read it, I have to say it is in fact rather disturbing. I sure hope that this kind of awful crime never occurs in the Orange County area: The Men Accused Of Kidnapping Have had their Bail set at half a million dollars. At this point in time, the bail that was set was for 3 individuals out of 4 who have been accused of kidnapping a fourteen year old girl. 3 of the individuals involved in this henious crime have pleaded not guilty and the fourth has yet to be actually at this point in time. They have been identified as Shawndrea Dorrough age 21, Patrick Jones age 20, Dywane Tousant age 22 and the four that has not been arraigned is Dominique Willis age 19. Needless to say, these buys need to get themselves a very good lawyer or two.
The charges originate from a rather shocking and sordid incident which occured when the fourteen year old in question had ridden a San Diego Trolley and was walking in North Park to a friends house when the four defendents apparently offered her a ride. They then took her to an Oceanside motel where she was forced to remove her clothes. The four allegedly took photographs of the girl that they planned to place on the Internet on Craigslist in order to sell the girl as a prostitute. Did I mention that these kids need a good lawyer? Oh yeah I think that I did.
When the four fell asleep the girl ran to a 7-Eleven at which point the police were called.

A preliminary hearing is scheduled for October 16th and the three people that have been arraigned have been charged with kidnapping for extortion, human trafficking, robbery, sexual battery and pimping.

Los Angeles man Steve Royds Pleads Guilty to narcotics Charges

In criminal legal news coming out of the Los Angeles area, according to various media reports Steven David Royds pleaded guilty in a plea agreement and was sentenced to some 4 years in jail. He was living at the Fairmont Newport Beach Hotel and upon searching his place of residence the body of his girlfriend Monique Felicia Trepp tirned up in a plastic Bin and kept with dry ice. I am sure that was a nice surprise for the police searching his pad. This guy really needs a good criminal lawyer.

The defendent in question entered his guilty plea at the Harbor Justice Center in Newport Beach, and it was reported that he had little choice but to accept the agreement or he could possibly serve some 9 years in the slammer for selling illegal narocotics, according to prosecutor Jeff Levy. The plea agreement would also mandate that he register as a drug offender.

The charges stemmed from an informant that had reported he was buying cocaine at a bar named the Classic Q at Newport Beach. This led to the search of Royds apartment and the discovery of Trepp’s body. Cash And Marijuana Found During Dog Search Of Home

In some interesting news coming out of San Diego, according to a police spokesman Derryl Acosta, officials have searched a home where they found marijuana and money. He went on to say that during a search of a college area home, officers along with a gang suppression unit used drug-sniffing dogs. The home located on Mohawk Street yielded bags of marijuana, suitcases that proved to have marijuana residue and along with approximately $18,000 dollars.  

There was also a loaded 9mm magazine found in the house and the search included the garage attic and the closet in the garage where much of this was located. According to officials the resident of the home was arrested on alleged possession of marijuana with the intent to sell. The resident of the home has not been identified other than what officials have released that he is said to have been on probation at the time of the search of the house. Criminal who Apparently Stabs Girlfriend Shot By Police

Here is another tale from the Twilight Zone known as Hollywood:

An incident that occurred in the 3200 block of Burton Avenue forced Los Angeles police officers on the scene to shoot a man. The criminal defendent in question that was fatally shot allegedly stabbed his girlfriend with a weapon which was a long knife or sword, says Los Angeles Sheriff’s Sgt. Rich Pena. He injured one officer by attacking him with the metal weapon and officers deemed him dangerous after the stabbing and the attack on them. Out of fear for their safety while trying to take the man into custody he was fatally shot by officers.

The unidentified man died on the scene of the shooting, his girlfriend was transported to an area hospital and is expected to survive the stabbing and the wounded officer was treated and released from the hospital. The woman’s condition has not been released or the injuries she sustained during the stabbing.  I giess this criminal will not be needing a lawyer after all.

The Incredible, Edible Egg

How many of you here are egg fanatics like I am? Do you like them scrambles, over-easy, sunny side up or perhaps poached? I guess it does not really matter too much. Eggs have long been a type of food which has been argued as to whether or not if it is good or bad when eaten since they happen to have some cholesterol. Of course they are also rich in vitamins, minerals, omega fatty acids and protein. The arguement is on again with various health experts vying to urge individuals to injest eggs since they have great nutrients such as iron, folate and choline and are a relatively  low calorie food which is also very filling.    For example, the Diabetes Association agrees and feels while they are a great way to get protein diabetics should limit their egg intake to three every week, but this does not include foods like cake or pancakes which may contain egg. This is since they would be diluted and so would the amount of cholesterol. By the way another possible source is Himalayan goji juice which has been individuals with some excellent health and wellness benefits. Sheriff Chief Deputy To Serve Time Behind Bars

I recently got back from the great windy city of Chicago and I wanted to share some out of state legal news with you guys. Dearl Hardy, who is the former Chambers County Sheriff Chief deputy, has used up all of his various legal related options and will start serving a 6-month sentence. The first charge that he was tried and convicted of was perjury and he was ordered to surrender himself in the 344th District Court to start his jail time.
The conviction charges go all the way back to September of 2001 when a deputy arrested a resident on a traffic violation and the defendent in question ordered the deputy to charge the man with a much more serious dui charge. The deputy felt there was no reason for this rather harsh charge and the individual unjustly charged eventually brought on a lawsuit against the authorities.
The defendent served under former sheriff Monroe Kreuzer who lost his office when his term was up, due in part to an administration which was burdened with many lawsuits.
He has now used up all of his appeals and the 14th Court of Appeals in Houston, Texas reversed his conviction only to have the Court of Appeals then rule against him and the Court of Criminal Appeals refused to hear the case. A lot of strange legal moves went on in this particular case as you can plainly see.
He will now have to spend 6 months in the Chambers County Jail where the original suspect was placed following his arrest. I wish to switch gears for a moment now for a quick plug. In a statement by the First District Attorney Dan Brady, it was basically said that it is great to see the Hardy case finally settled and the reputation of the police department there restored to it’s original high level of credibility and integrity. He also said that Mr. Hardy was simply a bad officer.  I second that opinion here.
